Feyenoord ONE Terms of Use

These Terms of Use apply to the use of Feyenoord ONE, a media service provided by Feyenoord that makes Feyenoord content available through the official Feyenoord website and the official Feyenoord app. Full access to Feyenoord ONE is exclusively available to members of Het Legioen or individuals in possession of a valid voucher. Access is included as part of a Het Legioen membership. Feyenoord ONE is offered by Feyenoord Rotterdam N.V..

Article 1. Use of the Service

1.1

Feyenoord ONE allows you to watch audiovisual content made available by Feyenoord, including but not limited to match footage, highlights, commentary, behind-the-scenes content, documentaries, interviews and reports. Certain content is exclusively available to Het Legioen members.

1.2

To access all content available on Feyenoord ONE, you must be a member of Het Legioen or possess a valid voucher. Without a Het Legioen membership or voucher, you may still use Feyenoord ONE, but access to content will be limited.

1.3

You must protect access to your account by means of a password and keep your password strictly confidential. Feyenoord is entitled to assume that all actions performed through your account after logging in with your password are carried out under your supervision and responsibility. You are liable for all such actions.

1.4

Your access to Feyenoord ONE is personal and non-transferable. You may not transfer, gift, share or otherwise make your access to Feyenoord ONE available to any third party.

1.5

The use of Feyenoord ONE involves the processing of your personal data. For more information, please consult Feyenoord’s Privacy Statement.

1.6

Feyenoord ONE is offered by Feyenoord as part of a Het Legioen membership.

1.7

If your Het Legioen membership ends for any reason, your right to full access to Feyenoord ONE will automatically expire. In such cases, you will not be entitled to any separate refund or compensation in relation to Feyenoord ONE, and you will only have access to content that is available without an account.

Article 2. Rules of Use

2.1

You may not use Feyenoord ONE in violation of these Terms of Use or any applicable Dutch or other laws and regulations. Feyenoord may impose additional conditions for the use of Feyenoord ONE through its website or app. You must comply with these Terms of Use and any additional conditions that may apply.

2.2

If Feyenoord determines that you are violating the provisions of Article 2.1, or receives a complaint regarding such a violation, Feyenoord may take appropriate measures to end the violation.

2.3

If, in Feyenoord’s opinion, your use of Feyenoord ONE causes or may cause disruption, damage or any other risk to the operation of Feyenoord’s or third parties’ computer systems, networks or internet services, Feyenoord is entitled to take any measures it reasonably considers necessary to prevent or eliminate such risk.

2.4

Feyenoord reserves the right to report any suspected criminal offences to the relevant authorities. Furthermore, Feyenoord may disclose your name, address, IP address and other identifying information to a third party claiming that you are infringing its rights or violating these Terms of Use, provided that the complaint appears sufficiently substantiated, there is no other reasonable way to obtain the information, and the third party has a legitimate interest in obtaining it.

2.5

Feyenoord is entitled to recover any damages resulting from violations of these Terms of Use from the responsible user.

Article 3. Availability and Maintenance

3.1

Feyenoord will make reasonable efforts to keep Feyenoord ONE available but does not guarantee uninterrupted availability of the service.

3.2

Feyenoord actively maintains Feyenoord ONE. Maintenance may take place at any time and may temporarily limit the availability of the service. Where reasonably possible, maintenance will be announced in advance.

3.3

Feyenoord may modify, suspend or discontinue the functionality of Feyenoord ONE from time to time. While feedback and suggestions from users are appreciated, Feyenoord retains sole discretion regarding any changes implemented.

Article 4. Content and Intellectual Property

4.1

The content available on Feyenoord ONE may change from time to time. Feyenoord reserves the right to add, modify or remove content without prior notice.

4.2

The quality of content may vary depending on the device you use, your location, the speed of your internet connection and the quality of the original recording. You are responsible for ensuring that you have suitable equipment and connectivity to view the content optimally.

4.3

Feyenoord ONE, the associated software and all content available through the platform are the intellectual property of Feyenoord and/or its licensors.

4.4

Feyenoord ONE and its content contain technical protection measures developed and implemented by Feyenoord and/or third parties. You may not circumvent, disable or otherwise interfere with these protection measures in any way.

4.5

Unless expressly permitted by applicable law, no content made available through Feyenoord ONE may be modified, copied, distributed, made available to third parties or otherwise used without the prior written consent of Feyenoord.

4.6

More specifically, you may not publicly display, broadcast, communicate or otherwise make content available beyond the private domestic sphere, nor enable others to do so.

Article 5. Liability and Force Majeure

5.1

Except in cases of wilful misconduct or deliberate recklessness and only to the extent permitted by law, Feyenoord’s liability shall be limited to the amount paid by you during the three months preceding the event giving rise to the damage.

5.2

To the extent permitted by law, Feyenoord shall not be liable for indirect damages, consequential damages, loss of profits or loss of anticipated savings.

5.3

Any right to compensation is conditional upon you notifying Feyenoord in writing of the damage as soon as reasonably possible after becoming aware of it.

5.4

In the event of force majeure, Feyenoord shall never be obliged to fulfil its obligations or compensate any damage resulting therefrom. Force majeure includes, but is not limited to, internet outages, failures of telecommunications infrastructure, power failures, civil unrest, mobilisation, war, transport disruptions, strikes, lockouts, business interruptions, supply chain disruptions, fire and flooding.

Article 6. Changes to Prices and Terms

6.1

Feyenoord may amend these Terms of Use at any time.

6.2

Any amendments or additions will be announced through Feyenoord ONE at least thirty (30) days before they take effect, allowing users sufficient opportunity to review them. Continued use of Feyenoord ONE after the effective date shall constitute acceptance of the amended Terms of Use.

Article 7. Miscellaneous Provisions

7.1

These Terms of Use shall be governed exclusively by the laws of the Netherlands.

7.2

To the extent not otherwise required by mandatory law, all disputes relating to Feyenoord ONE shall be submitted to the competent court in Rotterdam, the Netherlands.

7.3

If any provision of these Terms of Use is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions. In such circumstances, Feyenoord shall adopt a replacement provision that reflects, as closely as legally possible, the intent of the original provision.

7.4

Feyenoord is entitled to transfer its rights and obligations under the agreement to a third party that acquires Feyenoord ONE or the relevant business activities associated with the service.
